Recently, a shocking incident of an organ transplant case came to light. This is the case of a 28-year-old man named Kapil from Sirsa. Kapil allegedly sold his kidney to a person from Sonipat with kidney failure by making fake documents. Abhishek, who is the transplant coordinator of a private hospital in Jawaharpur, Mohali, helped Kapil in this. An Overview of the Mohali Case

The case involves Indus International Hospital, located near the village Jawaharpur in the Mohali district of Punjab, India, where a kidney transplant was done against a promised payment of INR 10,00,000 (ten lakhs) from an unrelated donor.

According to reports, the hospital’s coordinator, Abhishek, was involved in the fraud, and two other people, along with Abhishek, have been arrested in connection with the case.

To begin with, the donor, Kapil, a 28-year-old resident of Sirsa, reportedly agreed to sell his kidney for Rs. 10 lakhs to Satish Tayal – the patient. Satish Tayal is a resident of the Sonipat district of Haryana who needed a kidney. Abhishek prepared Kapil’s fake identity in the name of Satish Tayal’s son Aman Tayal, which includes his Voter ID and Aadhar Card.

The transplant was performed on March 6, 2023, using fake documents and without proper medical evaluation or screening of the donor.

Kapil alleges that he was promised Rs 10 lakh for selling his kidney but was only given Rs 4.5 lakh after the transplant. To make matters worse, he was locked in a room and left to fend for himself after the surgery.

Now, as Kapil was still locked in the room, he wilfully got the received amount of INR 4 lakh invested by his friend in an attempt to double his money. This, Kapil did on the advice of his friend, only to find later that he lost all his invested money, leaving him with neither money nor a kidney. Desperate and alone, he finally lodged a complaint on the police helpline number 112.

The Police Action & Investigations

Further investigation by the Mohali police revealed that this is not the first case in Abhishek’s career. A total of 34 transplants have taken place in this hospital under Abhishek as the transplant coordinator, and those cases are now being investigated. Abhishek is currently being held on remand.

What Does the Law Say?

The legal framework for organ transplantation in India is governed by the Transplantation of Human Organs Act (THOA). In 1994, the Government of India promulgated THOA. However, it was implemented in 1995 and revised in 2014, increasing the scope of organ donation and including tissues for transplantation. Furthermore, the act made the commercialization of organs a punishable offense.

The THOA, 2014 states, ” In the case of the live donor and the recipient being close relatives, an organ transplant DNA Test is mandatory along with Form-5.” In India, Organ Transplant DNA tests are done for many cases, including-

  • DNA Test for Liver Transplant

THOA, 2014 also legalized the donation of organs from brain-dead people by their relatives in India. Brain death is also called Brain Stem Damage, in which the brain is literally dead and the body cannot survive without 24X7 life-support.
